Terms of Service

1. About these terms

These terms govern your use of the NeuroSwift website and the service we provide. By submitting an enquiry, booking an assessment, or using this website, you agree to them.

Please read them alongside our Privacy Policy and Cancellation Policy.

2. What NeuroSwift does, and what it does not do

NeuroSwift is a coordination service. We take your enquiry, work out what you need, match you with a suitable practitioner, and arrange your appointment.

NeuroSwift is not a health service provider. We do not conduct assessments, provide clinical advice, diagnose, treat, or write reports.

Your assessment is delivered by SPOT4You (ABN 53 684 066 091), a registered NDIS provider, through practitioners it employs or engages. Spot is responsible for the clinical service, its quality, and the professional conduct of the practitioner. See our Spot relationship disclosure.

Nothing on our website is clinical advice. Information about assessment types, timeframes or outcomes is general information only.

3. Who can use this service

You can use this service if you are 18 or over, or if a parent, guardian, nominee or other authorised person is acting on your behalf.

If you are acting on someone else's behalf, you confirm you are authorised to do so and to provide their information to us.

We may decline an enquiry where we cannot appropriately meet your needs, no suitable practitioner is available, or the service you need falls outside what our practitioners provide. If we decline, we will tell you and, where we can, suggest where else to look.

4. Making a booking

  1. You complete our intake form.

  2. We review your enquiry and, if we can help, match you with a practitioner.

  3. We send you a service agreement and a payment request.

  4. A time is held for you pending payment.

  5. Once payment is confirmed, your appointment is confirmed and you receive a calendar invite.

A time held pending payment is not a confirmed booking. Held times are released after 5 days if payment is not received.

The service agreement you sign governs the assessment itself. Where these terms and your service agreement conflict on a matter relating to the assessment, the service agreement prevails.

5. Information you give us

You agree that the information you give us is accurate and complete as far as you know. We rely on it to match you with the right practitioner, so if it changes, please tell us. We are not responsible for an unsuitable match that results from information we were not given.

6. Fees and payment

Fees are set out in your service agreement and payment request before you commit. Fees are in Australian dollars.

Payment is required before your appointment is confirmed, unless we have agreed otherwise in writing, for example where a plan manager is paying directly.

Payments are processed by stripe. Their terms apply to the payment transaction.

NDIS funding. If your assessment is funded through your NDIS plan:

  • You are responsible for confirming that your plan has funding available for this support and that the support is consistent with your plan.

  • Where you are plan managed, we or Spot will liaise with your plan manager, but you remain responsible for the fee if funding is not approved or is exhausted.

  • Where you are self managed, you pay us directly and claim through the NDIS portal.

If funding is declined or withdrawn after your appointment has been delivered, supporting documentation will not be released and costs will have to be paid by client.

7. Cancellation, rescheduling and refunds

Our Cancellation Policy forms part of these terms. In summary, we ask for at least 48 hours' notice, and a fee may apply for short notice cancellations and non-attendance.

Refunds are dealt with in the Cancellation Policy. Nothing in these terms limits your rights to a remedy under the Australian Consumer Law.

8. Telehealth

Assessments are delivered by telehealth. You will need:

  • A device with a working camera and microphone

  • A reliable internet connection

  • A private, quiet space where you can speak freely

Tell us in advance if any of these is a problem. We can often help, and in some cases an alternative arrangement may be possible.

We are not responsible for the performance of your internet connection or device. Where a technical failure prevents an appointment proceeding, the Cancellation Policy sets out what happens.

9. Communications

By providing your contact details you agree that we may contact you by email, SMS and telephone about your enquiry and your appointment. These are service communications and you cannot opt out of them while your booking is active, though you can withdraw your enquiry at any time.

Marketing communications are separate and you can opt out at any time.

10. Timeframes

We aim to arrange assessments faster than the usual route, but we do not guarantee any particular timeframe. Availability depends on practitioner capacity, your own availability, funding approval, and clinical requirements including minimum preparation time. Any timeframe we mention is an estimate.

11. Your obligations

You agree to:

  • Attend your appointment at the confirmed time, or give notice as set out in the Cancellation Policy

  • Treat our staff and practitioners with respect

  • Not use our website or service unlawfully, or to interfere with its operation

  • Not attempt to access another person's information

We may suspend or decline service where these obligations are not met.

12. Website content and intellectual property

All content on this website is owned by NeuroSwift or licensed to us. You may view and print it for your own personal use. You may not reproduce, republish or use it commercially without our written permission.

13. Third party links

Our website links to other sites, including Spot's. We do not control those sites and are not responsible for their content or their privacy practices.

14. Liability

Your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have that cannot lawfully be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to resupplying the service or paying the cost of having it resupplied.

Subject to the above:

  • We are not liable for the clinical service, the conduct of a practitioner, or the content or outcome of an assessment. Those are the responsibility of Spot and the practitioner.

  • We are not liable for indirect or consequential loss, including loss of funding, loss of opportunity, or delay in accessing supports.

  • Our total liability in connection with our service is limited to the fees you have paid to us in connection with the relevant booking.

15. Complaints

We want to hear if something has gone wrong. Contact us at contact@neuroswift.solutions or 0400553117. We will acknowledge your complaint within 5 business days and aim to resolve it within 20 business days.

Complaints about the assessment itself, or about a practitioner, can be made to Spot, or to the:

NDIS Quality and Safeguards Commission

You can make a complaint to the Commission at any time. You do not need to come to us first, and doing so will not affect your service.

16. Changes to these terms

We may update these terms. The version that applies to your booking is the one published when you made it. We will tell you about material changes.

17. General

If any part of these terms is found to be unenforceable, the rest continues to apply.

These terms are governed by the laws of NEW SOUTH WALES, and you and we submit to the courts of that jurisdiction.
